MURDERS OF BLACK MEN–TIME TO CHANGE THE CULTURE

Crimes against Black men have a historical underpining in America. America’s original sin–slavery–created the notion that Black life had no value. Slaves could be owned and they belonged to their master. The master could kill, rape and sale them with impunity. Slaves had no legal rights. The Klu Klux Klan and whites in general would burn, bomb, rape, kill Blacks and suffer no legal consequences. Blacks were only considered to be 3/5th of a human being. This thought permeated the culture. Blacks did not have civil rights and could not vote. They obtained Civil Rights in 1964 after many marches, deaths and struggle. Voting Rights would follow.

The criminal justice and judicial systems did not follow the legal rights of Black men. To this day, both systems still incorporate the Jim Crow laws and its concepts that Blacks have no rights and do not have to be treated equally. My recent experience with the Texas Judicial System highlight this concept. I called a police officer a light in front of his peers. He and his white friends retaliated as if I were a criminal instead of a law abiding citizen practicing law and social work. It was widely verbalized that I was a criminal because I was a Black woman. I was falsely charged with a crime when under the law I did not have any criminal liability for anything. Moreover, under federal law, I could not be charged with the crimes for which I was charged and incarcerated. I was told that the state constitution, state and federal statutes and federal constitution would be suspended in my case. I appealed this ruling and my documents, pleadings and trial transcript was destroyed such that it was. Even the United States Supreme Court agreed that if you are Black, female and poor in America, the constitution, laws and rights do not apply and states do not have to extend those rights to you. This is what my case stands for. I wrote a book about it called I AM NOT BENEATH THE LAW.  It is currently being sold on Amazon.

My position is that if a white person’s pleadings had been torn up and new pleadings created in all federal courts including the United States Supreme Court; some news entity would have reported on this. I was Black and an exception was made. Blacks have been murdered by whites since slavery and there are little consequences. We remember the Rodney King incident. A jury found them not guilty. When a prosecutor wants a guilty verdict, he gets a white jury knowing that they will be unfair and only look at his race. He will be deemed guilty because of his race and not the evidence. A secret trial was conducted in my case. The United States Supreme Court indicated by its non action that this is okay if you are Black. You do not have to be extended constitutional protections. I had seventy three United State Constitution violations and over three hundred reversible errors including no trial transcript. The court reporters at a hearing before the judicial commission reported that they did not record or transcribe more than a third of my trial. They deleted my objections from the record to deny me appellate review. I found out that this is how they do it in the south.  No court will give a fair review of my case. I am Black. This is how Blacks are still being treated in America. They can be shot down by police and all they have to do is state that they were in fear for their lives. Stephon Clark was at home without a weapon and was shot twenty times apparently mostly in the back. Let us see how they treat this matter.

It is time to look at the source of this notion of where Black life was devalued and see if this notion should continue. Nothing would have changed in the race area but for athletics and wars. A former soldier told me that in WWI and II,  the Germans would post announcements to Blacks and question them as to why they were fighting and they did not have any rights in America. Muhammed Ali stated “No Vietnamese person has ever called me “nig.r’. I will not go. Other athletes raised their fists in the Olympics.  Red Aurbach and the Boston Celtics won everything with Bill Russell and his crew. Other teams had to join Red and get Blacks to try to defeat him. Sports integrated. The rest is history. Athletes stood up in the way they performed. Their value has not translated to the ordinary person. Things are deteriarating in society in terms of the value of Black life in the criminal justice and the judicial systems. These are the last two systems to make changes. Change is needed here. They are the key. Unless the judicial system becomes fair and the constitution is followed for all, we will continue to have problems. We should stop hearing that Blacks and browns cannot go to certain counties, cities and states because they will not be treated fairly. No lawyer should ever tell me to save my money because no judge in this town will rule in favor of a Black person. We as a sociey have got to learn to be better brothers and country men and loving to each other. All life matters and should be valued. It is time to change the culture on the killing of innocent and unarmed Black men. In American Black has become the sin or the crime instead of crime itself. It is time to stop this behavior. IT IS TIME FOR A CULTURAL CHANGE.!
