I RECENTLY FILED A PETITION FOR REVIEW IN A TEXAS COURT

 In Uncategorized

I recently filed a Petition for Review in the Texas Supreme Court.  Some strange things are happening.  I filed my case on the 5th of July.  To date, I do not have a case number or anything from the court.  Wonder what is happening.  I do not have any hope or expectation that it will be reviewed.  It never is.  I am just wondering what twist they will put on it this time.  The lower court ruled that my name could be forged on the green card by my opponent when I was out of state and this was still service.  Filing with the court was considered service on the person despite the rules.  My opponent had someone break into my home to steal the records so the court records could be altered.  The opponent alleged statute of limitations but would not produce a copy of the final order or settlement papers for the case when requested.  The HOA and attorney did not serve me within the TRCP 21.  The Appellate Court ruled that service was sufficient with the filing on the court and the forged signature on the green card by the opponent when I was out of town was personal service.  I am curious as to what the Texas Supreme Court will do.  Probably deny review and avoid the issue altogether. Oh, well.

Update of the latest.  I recently received a letter from the court that this was their second notice for a fee.  The only correspondence that I had received from the court was a card of advice for my opponents.  The court told them that if they filed a waiver instead of an answer that the case would not be reviewed by the court.  All of the opponents promptly filed waivers.  I will wait for the denial of the petition to move forward.
