Corruption in state and federal courts—Some thoughts

 In Uncategorized

Spoke to the clerk of the Texas Court of Criminal Appeals.  Learned that the Texas Court of Criminal Appeals had not imaged any of my motions or documents.  I filed a petition for discretionary review with a motion to file an over the limit application which was denied.  I was given time to resubmit with the correct  pages per the rules.  I did this.  Recently learned that they did not image my documents and sent them back to the 10th Court of Appeals where they were destroyed.  The only thing they have that I filed with the Court of Criminal Appeals is my signature page.  Only one page of the document that I filed exists.  My application and all the exhibits to it have been destroyed.  I also spoke to two people in the clerk’s office of the Southern District of the U.S. District Court including Heather Carr who informed me that she did not know why my original application for Writ of Habeas Corpus and the exhibits had not been imaged.  The application was imaged but the exhibits that I filed were not.  She did not know who substituted other documents and a different order in the application that I filed.  She told me that when my originals were not imaged, they had been destroyed and not returned to me. She had no explanation for why my original documents were never imaged.  When the clerk does not image your pleadings with your exhibits that you file, opportunity to alter the documents and your pleadings exists.  The 10th Court of Appeals points the finger at the Texas Court of Criminal Appeals as the one who destroyed the documents, the Texas Court of Criminal Appeals states they returned my file to the 10th Court of Appeals on February 16, 2011.  I requested records and saw my complete file in 2012 and the records had been completely destroyed at that time.  The last signature page did not exist.  Now they only have my signature page and no explanation about the destruction of the rest of my document and the substitution of other documents. My position is that this was done to defeat my appeal.  The order of the 10th Court of Appeals has been destroyed and a new one written that was never sent to me and which I was never given an opportunity to appeal.  Defendant are entitled to appeal as a right in Texas.  I was clearly denied due process in this situation.  However this does not matter to anyone if Fifth Circuit of the United States Court of Appeal and the United States Supreme Court have ruled that the Texas Constitution and the United States Constitution, federal laws and treaties do not apply and will not be enforced in your case.  The only question is, is it just my case they are doing this to.  How may people are dying and being wrongfully incarcerated in this manner.
