Bill Cosby—–Some thoughts

The prosecutor should not retry Bill Cosby. Cosby’s trial is a political trial. It is worse than the criminal trial of O.J.Simpson. Who has ever heard of anyone being tried for trying to take back their stolen property even with a weapon.

I am not a fan of Bill Cosby. I watched his show and liked it at the time. I never liked Bill Cosby. I liked his stand up act about children. I did not like his stand up act when he bragged about giving women spanish fly or drugs. I did not think this was funny. I do not like men who are unfaithful to their wives and abuse women. Despite my personal dislike of Cosby, he should never have been tried in this case on these facts and he should not be retried for the same reason. The prosecution tried this case for political reasons.

First, the prosecutor ran on the issue of trying Cosby and incarcerating him for alleged abuse of women. One is innocent until proven guilty. This trial has nothing to do with evidence. The use of bad acts is an effort to try to convict him of the present crime based on his past behavior.

I would not have a problem with the Cosby case if the judicial standards, trial and appeal process was fair and was not race based. Cosby may be an exception. He may get a fair trial because he is well known and he has enough money for his defense. I am concerned that he is being tried as a Black male with all that this means in America.

Women who have been assaulted need vindication. However, these were not children. They could have made timely complaints. The facts of this case do not warrant prosecution.

First, the prosecution assured him that if he went through the civil case and waived his 5th Amendment Right that he would not be prosecuted criminally.  Cosby’s attorney did not get this in writing. This was malpractice. Once Cosby changed his position and engaged in the civil trial, the rules changed.  No affidavit of nonprosecution was ever signed.

The prosecution has other problems.  Out of seventy two phone contacts, the complaintant initiated fifty three contacts. Many of the contacts were after the alleged assault.  Moreover, the victim and her parents attended a Cosby Show after the assault. Additionally, she did not report the alleged assault until one year after the alleged assault. This looks like the woman scorned. There was no testimony that I heard that he sneaked the pills in her drink or forced her to take the pills. She took them voluntarily. I did not attend the hearing, but if these facts are true, they are problematic for the prosecution. Cosby is not a saint. He is entitled to a guilt beyond a reasonable doubt verdict.  In this case, there is reasonable doubt as to the crime of rape based on the facts. I was date raped.  I did not want to ever see the person again. I did not ever call him and I would never have considered taking a call from him. I would not have made fifty three calls to him and then taken my parents to meet him. This was a political trial. It received the right result and should not be retried. Whatever you think about men who drug women, Cosby is entitled to a fair trial by a jury of his peers.
